To this new way of conceiving the legal rationality, the author calls it “Neo rhetoric”.Resumen: El presente trabajo ofrece una categorización y jerarquización de las diversas etapas estilísticas en las que se ha presentado la retórica en el tiempo, a efecto de contrastar con la concepción que se propone en el artículo de un nuevo modo de entender y de construir el discurso en la disputa judicial, a partir del concepto de “racionalidad”entendido como discurso argumentativo.
