Sumario:The objective of this article is to analyze the preventive measure trial against unconstitutionality due to legislative omission. This investigation evolves around three topics: the generalities of unconstitutionality due to legislative omission, the relationship between the principle of relativity of sentences and the inadmissibility of the preventive measure trial when the act claimed consists of an omission of the legislator; and the relationship between the constitutional reforms of June 6 and 10, 2011 -which imply the introduction of a new constitutional framework-, with the possibility that the legislative omission will be fought through the preventive measure trial, especially as of the decision of the First Chamber of the Supreme Court of Justice of the Nation in the preventive measure under review 1359/2015. Finally, in the development of this research paper, historical, analytical and comparative methods were used, as well as the documentary technique.
