| Sumario: | The legal obligation of the Spanish State to incorporate into national law, many EU directives on occupational health, through the harmonization of national legislation with European Community law, was resolved through the adoption of Law 31/1995, 10 November, about Occupational Hazard Prevention, satisfy the transposition into national law Directive 89/391/EEC, 12th June 1989, concerning the implementation of measures to encourage improvements in safety and health of workers at work. This directive includes the introduction in the prevention area, a specific model of representation of workers in this matter. In this study, will analyze, from the point of view of capabilities and faculties corresponding to these representatives, how through the development of a wide variety of Community measures have been promoted the participation rights of workers in safety and health through the intervention of the legislature national and collective negotiation. |
