Resumo:The present study revises some theories of management instruments elements which have an influence on company restructuring focusing on workers representatives and their new challenges. Workers� participation in corporations through their representatives former right of advice, as an instrument for the cautionary management is asummed with the passage of Law 38/2007, 16 November. Currently, there is an need for a legal reform about individual dismissal [Article 52.c) ET] to ensure the implementation and protection of viability plans.
