Sumario:In this article we propose to analyze the impact of the total deregulation and definancing of the State with regard to the field of education, partially replacing the proposals contained in the first Decree of Necessity and Urgency (70/23) presented by the current government of Javier Milei days after taking office, and in the subsequent Base Law presented to the National Congress for approval. We begin by analyzing how this political project affects the Right to Education as a Human Right given that we observe a relationship that the current government has deepened between neoliberalism and the commercialization and privatization of education. One of the mechanisms to achieve this purpose is the proposal to install financing on demand, including educational vouchers or coupons, and tariffs for higher education. The analysis of the main political instruments (DNU and Bases Law) allows us to outline the risk involved in modifying the ideological political substrate on which public education in our country is based as a social right. As part of the “new right”, “extreme right” or “radical right”, the government of Javier Milei advances under a regime of cruelty whose social practices question the egalitarian principles of democracy.
