| Sumario: | The research aims to analyze the administrative morality and its densification (or growing concern) as a fundamental right in Brazilian Democratic State of Law. The Federal Constitution of 1988, on more than one occasion, makes normative reference to morality, including demanding the morality as a clear constitutional principle of mandatory obligation by the direct and indirect public administration of any powers, may they be the Union, State, Federal District or the Cities. The standards (or norms), as a genre, have the principles and rules as its species. The doctrine is controversial on the legal nature of the norm species represented by the administrative morality. In conclusion, the administrative morality, as a legal norm, is not restricted to a mere principle of public administration, but also bears the character of rule and, listed as a fundamental civil right, fulfills its function as a foundation of Democratic State of Law, inclusive as an instrument which contributes to the achievement of the objectives of the brazilian Federal Constitution in pursuit of the common good. The method used is the inductive one and the procedure is the bibliography, doctrinal and legislative review. |
