Resumo:The Hart-Dworkin debate is one of the most significant issues of Philosophy of Law. It concerns a series of distinct controversies, in which there is the one about the possibility of existing, in legal practice, disagreements about the foundations of law (so-called theoretical legal disagreements). Within this scope, a theoretical research was carried out in order to provide a framework for dialogue between these two authors, based on the controversy about the existance of theoretical legal disagreements. For this purpose, the interpretative analysis of positivist and dworkinian speech was used as the methodological procedure. Therefore, this essay is going to examine Dworkin’s objection to legal positivism, going through positivists explanations over the years in order to, in the end, outline some conclusions about the limits to the existance of such disagreements, stipulated by the legal system.
