At the end of the research, there was proof of the initial hypothesis, in the sense that Restorative Justice is able to act ina complementary way to the current model and justice, as long as it is based on Human Rights, with regard to the dignity of the human person.Este artigo surgiu como fruto da pesquisa de mestrado e objetiva aportar cientificamente a Justiça Restaurativa brasileira nas bases das Epistemologias do Sul, com foco nos Direitos Humanos, em especial a dignidade humana. Utilizando-se do referencial teórico das Epistemologias do Sul, propõe-se que devam ser resgatadas outras formas de solução de conflito, que não apenas o monopólio de aplicação do Direito pelo Estado, devolvendo às partes a gestão do conflito. A pesquisa utilizada é exploratória, para ter uma visão amplificada do problema e o trabalho é natureza qualitativa, estruturado em uma pesquisa documental e revisão de literatura, encerrando com análise de conteúdo.
