Sumario:This article discusses the considerations about the current Brazilian scenario of granting payroll loans to the elderly, highlighting solutions regarding payroll loans without the victim's consent, emphasizing the need for administrative protection through the agencies of the National Consumer Defense System and by the judiciary when analyzing abusive practices by fraudulent financial institutions. The goal is to show in theory the fraudulent conduct, as well as the penalty for those who practice fraud, as well as recognizing the right of refusal of those who are threatened for such purpose. The hypervulnerability of the elderly is subject to the fraudulent practices of financial institutions that are not committed to respecting elderly consumers. In this article, the problems faced by the victims were also pointed out, noting the great confidence in particular of the elderly who have the INSS.
