Sumario:With the advancement of the internet, virtual rape has become a significant issue, demanding regulations to punish and reduce the spread of this crime. The primary purpose of this study is to conduct a critical analysis of virtual rape within the Brazilian legal framework. This involves investigating the challenges faced in obtaining digital evidence. Specific objectives include examining the evolution of virtual rape, its characteristics, and legal impacts, analyzing relevant Brazilian legislation and its interpretation by courts, as well as exploring methods of digital evidence collection and their applicability in legal proceedings involving virtual rape. The research seeks to understand how virtual rape affects victims, causing psychological harm, and what specific challenges exist in producing evidence to validate these crimes in the legal system. The research methodology will be conducted in a bibliographic, exploratory, and descriptive manner, using critical analysis of case law, legislation, and academic studies on the topic. The article provides a detailed analysis of the challenges faced in producing digital evidence in cases of virtual rape, highlighting the need for adaptation of the legal system to effectively address these crimes.
