description La tesis que se presenta a continuación planteó como objetivo el analizar la necesidad de incorporar en la legislación penal militar policial, la figura de la reserva del fallo condenatorio en el Código Penal Militar Policial, homologando dicha situación existente en el vigente Código Penal peruano, situación que evitaría la aplicación de sentencias con pena privativa de libertad para militares y policías. En la discusión de resultados se ha evidenciado la necesidad de su incorporación, a fin de descongestionar la carga de procesos y evitar mayores perjuicios en la situación laboral y línea de carrera de numerosos miembros de las Fuerzas Armadas y de la Policía Nacional del Perú. Como conclusiones se estimó la necesidad de regular de manera expresa, sea a través de una ley o un Decreto Legislativo, la figura de la reserva del fallo condenatorio, actualizando y mejorando, por ende, la normativa vigente.
