Sumario:This essay analyzes through a case study, the way in which the Mexican electoral system has passed through a continuous process of recalibration. This analysis vindicates the necessity of establishing stricter standards of judicial scrutiny on electoral expenditure. The core issue in this analysis focuses on the decision from the Mexican Electoral Court in the challenge of the results of the presidential election of 2012, which turned to be a momentous decision in Mexican electoral jurisprudence. This essay vindicates the necessity for the Mexican Electoral Court to articulate a doctrine on “determinacy” to appraise the overall effect of violations to electoral rules on the final result of a given election.
