Descripción
Sumario:This article considers electoral integrity as a fundamental right in a world that is undergoing a clear democratic regression and in which attacks on electoral institutions are increasingly common. It points out current elements, because in Mexico an electoral reform is being discussed that in the opinion of some would limit the functions and scope of the national electoral body. It presents a novel vision of electoral integrity, since up to now it is not usually considered as a fundamental right. The work establishes a thesis and seeks to substantiate that integrity is a fundamental right. It is based on an inductive method that seeks to support this thesis through different arguments contained in the Mexican Constitution, jurisprudence of the Supreme Court and doctrinal opinions.
