While the analysis has focused mainly on what happens at destinations, the failure to comply with and violation of rights (recognized in national and international frameworks) in the places of origin has not been exhaustively analyzed. This situation promotes that migration takes place not as an election, a human right, but as a last option. Some implications of the adoption of the human rights approach are demonstrated in the paper. Finally, the Mexican case is presented to show that, in spite of the approach of migration and devel opment in which it has been positioned, there is no evidence of policies linked to the skilled diaspora that contribute to national development. Although it has designed programs and actions with this purpose, a conception prevails that finally questions, among others, the right to migrate.Este artículo muestra que la ausencia de un enfoque de derechos para el estudio de la migración calificada tuvo secuelas para su interpretación. Mientras que el análisis se ha centrado mayoritariamente en lo que ocurre en los lugares de destino, no se ha revisado exhaustivamente el incumplimiento y la violación de derechos —reconocidos en marcos nacionales e internacionales— en los lugares de origen. Dicha situación promueve que la migración tenga ocurrencia no como una elección, un derecho humano, sino como una última opción. Se exponen algunas de las implicaciones que conlleva la adopción del enfoque de derechos humanos. Finalmente, se presenta el caso mexicano para mostrar que, a pesar de que los enfoques de migración y desarrollo en los que se ha posicionado, no se observan políticas de vinculación con la diáspora calificada que contribuyan al desarrollo nacional.
