| Sumario: | Which are the fundamental rights? And what to do with challenge of the global market and particularisms? This two questions are the basis of this paper. The author considers that the rights which should be guaranteed by their importance are those which their defense is necessary for peace, the equality rights of minorities permitting an entire multiculturalism, and rights which protect weak persons facing the strongest ones. The State must guarantee fundamental rights not only in public areas, but also in private ones, including social rights and international law to combat the constitutionalism crisis in a globalization without rules and controls that increases differences among people. |
