Sumario:The urban land market in polygons with irregular settlements has been studied from various perspectives, however, the difficulties in understanding the reasons behind living in environments without adequate urban conditions have not been resolved. The general objective of this article is to study the factors that determine the decision of the possessors property illegally to occupy the space, and in particular the case study of the area called Cima de la Loma located in the upper part of the central area of the city is analyzed from Monterrey, Mexico. It was used like metodolgy the georeferenced analysis of information from the population, the visit to the field in conjunction with authorities to tour the area, as well as the application of the binary logistic regression method to the variables of interest referring. The result obtained indicates that there a tendency to regularize the properties of the possessors to the extent that their accessibility conditions are better in terms of physical conditions of the space and physical condition of the population, and of the factors of the population, like living in homes and better school preparation tend to encourage the decision of the possessors for one regularization.
