Sumario:Portugal widely recognized in its Political Constitution the people fundamental rights and the instruments of protection in case of transgression of these rights by the amparo suit. The Macau people, a Portuguese colony in Chinese territory, enjoy these rights and protection instruments. Nevertheless this article deals with the answer to the following question: how to guarantee these rights already obtained when Macau population is in a cession process of sovereignty from Portugal to China?
