Sumario:This contribution has as purpose to develop the ius constitutionale commune approach in Latin America (ICCAL) about Regional Transforming Constitutionalism by means of the analysis of The Concept of Politics of Carl Schmitt. This analysis articulates ICCAL making it differ from the current nationalist reaction, focused on the States of the Nation; it enunciates the conceptual weaknesses and proposes an alternative with the normative program of Latin American Transforming Constitutionalism. Likewise, it discusses by means of a criticism of Schmitt’s text the theoretical constitution of public law; and it also portrays ICCAL as legal theory.
