Sumario:“A few notes on financial liability of the Laws 39/2015, of 1st October, Public Administration Common Administrative Procedure and 40/2015, of 1st October, of the Public Sector Legal Regime”. The objective of these notes is to give account of the modifications, which new Laws 39/2015, of 1st October, of the Public Administration Common Administrative Procedure, and 40/2015 of 1st October, of the Public Sector Legal Regime, introduce in the regulation of the financial liability of Public Administrations. With the exception of segregation in two regulatory texts of rules applicable to the institution and regulation of patrimonial responsibility due to malfunction of the Constitutional Court, there are few substantial changes. New requirements and deadlines are introduced for actions demanding accountability of the State legislator and liability for breach of European Union Law. Rules pertaining to the initiation of the process could produce undesirable effects. On the other hand, little success is foreseen for the new simplified procedure.
