| Sumario: | The right of appeal in criminal matters has been considered to be part of the content of the right to due process. The Constitutional Court of Spain has stated that even though the right of appeal does not have express constitutional recognition, it is integrated into the right to a due process with all the guarantees enshrined in Article 24.2 of the Spanish Constitution, since this right is established in Article 14.5 of the International Covenant on Civil and Political Rights (hereinafter, ICCPR) and Article 10.2 of the Spanish Constitution states that the rules relating to fundamental rights and freedoms that the Constitution recognizes will be interpreted in accordance with said text. |
