Sumario:The broad statutory provision of criminal appeals in the Brazilian legal system, in addition to the constitutional provision of the writ of mandamus, made us to inquire about the use of the writ in our criminal field, both ideologically and dogmatically. Our hypothesis, which limited the writ of mandamus to challenge absurd, or manifestly illegal, judicial decisions, although ideologically confirmed, based on the philosophy of appeals in general, was not dogmatically affirmed. Nevertheless, it did not constrict us from conclude that most of the casuistic situations pointed out by our national doctrine are excessive.
