Sumario:The text addresses the problem of appeal and review of proof decisions in criminal process. In the first place, the author highlights the apparent tension between the guarantee of an appeal, as integral remedy and, on the other hand, the privileged epistemic situation of the first instance judge. From there, after a reconstruction of the way in which the probative reasoning has to be reflected in the judicial decision (according the requirements of the CPEUM and the CNPP), the author demostrates that that tension is more apparent than real. This allows to argue that the exclution by the CNPP of the possibility of treatment in appeal of errors in proof decisions is a bad solution. This is so, above all, because it claim to be a solution to a largely non-existent problem
