The doctoral thesis is divided into five chapters which deal with the difficulties in the implementation of the subrogation of the insurer, when it is an insurance land transport of goods. These difficulties are due mainly to the confusion in practice between the insurer's liability insurance carrier of the goods and the transport of goods. Thus the importance of distinguishing both types of insurance in identifying the third party against whom to direct the action the insurer of transport.El objeto de la tesis doctoral titulada “La subrogación de asegurador en el seguro de transporte terrestre de mercancías por carretera” es el estudio de la legitimación de la entidad aseguradora, en los seguros de transporte de mercancías por carretera, para ejercitar la acción de responsabilidad contra el causante del siniestro que dicha entidad ha asegurado. La tesis se estructura en cinco capítulos en los que se abordan las dificultades que presenta la aplicación de la subrogación del asegurador cuando estamos ante un seguro de transporte terrestre de mercancías. Dichas dificultades son debidas, principalmente, a la confusión generada en la práctica aseguradora entre el seguro de responsabilidad civil del porteador de las mercancías y el seguro de transporte de dichas mercancías.
