| Sumario: | EuropEan Court of Justice has begun to use the Charter of Fundamental Rights of the European Union as a legal binding instrument equivalent to the Treaty, and expanding the level of its Jurisdiction and its position as fundamental rights guarantor in European Union. However, this should be accompanied by a genuine guarantee of these rights and a detailed justification of its limitations and restrictions, that is not evident in all cases. |
