Sumario:This study deals with the phenomenon of real estate assets tokenization, namely, the digital representation of a direct real right over a specific physical asset through the token so that it can be circulated on a platform with DLT/blockchain technology. The transmission of the real right occurs via a smart (legal) contract, which self-executes pre-established agreements through the blockchain. Taking into account the particular legal nature of these rights, the possible implementation and usefulness of blockchain protocol in the Spanish Property Registry is analysed, bearing in mind the principles of legality, priority and public registry trust; concluding that the symbiosis between tokenization and the Spanish registry system would be mutually beneficial for real estate assets, but without forgetting the fundamental role of the Property Registry, which fully guarantees the protection of the registry holder against any disturbance of their rights.
