Sumario:This contribution analyzes the validity of a "kafala" for the purpose of obtaining an entry visa in Spain for family reunification according to the judgment issued by the Supreme Court on December 9, 2011. The commentary to the judgment highlights the problematic issues raised and the criteria followed by the Court for the legal solution. Specifically, it is about clearing if the legal representation attributed by the foreign law is sufficient to allow entry into Spain by family reunification according to the provisions of Article 17.1 c) of the Aliens Act.
