This work aims to propose a possible interpretation of the relationship between fundamental rights and corrective and distributive justice within the framework of the hermeneutics of private law. From an institutional perspective, it proposes a conjecture about the judge's sphere of discretion to make redistributive considerations in private law relations through the interpretation of constitutional principles, and examines the limits of such hermeneutical activity. Thus, it seeks to deduce a physiognomy of the application of fundamental rights in private law relationsLa discusión sobre la determinación del sentido y alcance de las reglas y principios se erige como uno de los grandes temas al interior de la ciencia jurídica, un debate apasionado abordado en distintas épocas y desde diversas perspectivas, que tiene como característica desplegarse sobre los contenidos más íntimos del Derecho delineando el modo en que este se conceptualiza a sí mismo. Este trabajo tiene como objetivo plantearse como una lectura posible respecto de la relación existente entre derechos fundamentales, justicia correctiva y distributiva en el marco de la hermenéutica del Derecho privado. Desde una perspectiva institucional, se plantea una conjetura acerca de la esfera de discrecionalidad del juez para efectuar consideraciones redistributivas a la relación de Derecho privado mediante la interpretación de los principios constitucionales, y se exámina el límite de dicha actividad hermenéutica. Así, se busca deducir una fisonomía de aplicación de los derechos fundamentales en la relación de Derecho privadoLa discussió sobre la determinació del sentit i abast de les regles i principis s'erigeix ​​com un dels grans temes a l'interior de la ciència jurídica, un debat apassionat abordat en diferents èpoques i des de diverses perspectives, que té com a característica desplegar-se sobre els continguts més íntims del Dret delineant la manera com aquest es conceptualitza a sí mateix. Aquest treball té com a objectiu plantejar-se com una lectura possible respecte de la relació existent entre drets fonamentals, justícia correctiva i distributiva en el marc de l'hermenèutica del dret privat.
