Resumo:The discussion on the determination of the meaning and scope of rules and principles stands as one of the major themes within legal science, a passionate debate addressed at different times and from diverse perspectives, characterized by its unfolding over the most intimate contents of law, outlining how it conceptualizes itself. This work aims to propose a possible interpretation of the relationship between fundamental rights and corrective and distributive justice within the framework of the hermeneutics of private law. From an institutional perspective, it proposes a conjecture about the judge's sphere of discretion to make redistributive considerations in private law relations through the interpretation of constitutional principles, and examines the limits of such hermeneutical activity. Thus, it seeks to deduce a physiognomy of the application of fundamental rights in private law relations
