It must be examined whether, beyond the problem of constitutionality, the retention of the courts created by legislative decree-law in the pre-democratic period is justified. This article gives an overview of the historical background and analyzes the comparative law and the precarious constitutional declaration of the TC and offers possible solutions in the event of an abolition.En España existe un conjunto de tribunales controvertidos desde la perspectiva del derecho al juez ordinario predeterminado por la ley: la Audiencia Nacional. Se le atribuye determinados asuntos de distintos órdenes jurisdiccionales que fueron sustraídos de los tribunales que ordinariamente hubieran debido conocer, alterando las normas generales de atribución de la competencia. Debe analizarse si, más allá del problema de constitucionalidad, queda justificado el mantenimiento de unos órganos creados en período predemocrático mediante Decreto-Ley. El presente trabajo hace un repaso a sus antecedentes históricos y analiza el derecho comparado, así como la precaria declaración de constitucionalidad realizada por el TC, ofreciendo posibles soluciones en caso de abolición.J.M.
