Sumario:Criminal mediation in our country is a challenge, since, despite being a regulated matter, little has been done so far on the matter. Taking into account the enormous potential that would result from the concrete application of this tool in the resolution of conflicts. In the Comprehensive Criminal Code, the structure of mediation is totally different from conciliation, in the latter the figure of facilitator is established, the same one that, together with the prosecutor, sends to the respective Criminal Judicial Unit so that the Judge approves what has been prepared. Time modifies the laws, but in the same way it must modify the thinking of the authorities, giving alternatives, we are only in the path of sanction and punishment, there is nothing additional that can compensate for the damage caused.
