Therefore, the different criminal organizations are developing certain criminal profiles that have as a common denominator, social dangerousness, and all its negative impacts. By virtue of the number of International Instruments issued and aimed at confronting organized crime, the laws worldwide have adapted their internal regulations to said treaties with the aim of correctly conceptualizing, characterizing and defining organized crime and its manifestations. Part of this is to adapt internal criminal regulations to said positions in a way that is understandable, clear and respectful of the technique of criminal law. It was drawn as a scientific problem: ¿If the criminal types of Organized Crime and Illicit Association, existing in the Ecuadorian criminal legal system to combat organized crime in Ecuador, should have decreased the rates of this phenomenon that exist today?, and, as a general objective: Analyze the legal configuration of the criminal types provided for in articles 369 and 370 of the COIP.........Este trabajo de investigación que lleva por título “La delincuencia organizada en el ordenamiento jurídico ecuatoriano”, se dirige a la obtención el Titulo de Maestría en Derecho mención Derecho Procesal, se preocupa por el hecho de que, en el orden mundial, la criminalidad organizada es un fenómeno que se presenta de manera frecuente, constante y a través de diferentes formas. Por ende, las diferentes organizaciones criminales van desarrollando determinados perfiles delictivos que tienen como denominador común, la peligrosidad social y sus impactos negativos. Por ellos, la Comunidad Internacional a través de los organismos pertinentes, ve la necesidad de crear varios Instrumentos Internacionales dictados y encaminados a enfrentar la criminalidad organizada es que, las legislaciones a nivel mundial han adaptado sus normativas internas a dichos tratados con el ánimo de lograr conceptualizar, caracterizar y definir correctamente el crimen organizado y sus manifestaciones. Parte de ello, es adaptar la normativa penal interna, a dichas posiciones de forma comprensible, clara y respetuosa de la técnica del Derecho Penal.
