| Sumario: | This research work entitled "Premium Criminal Law and its impact on the legal figure of Effective Cooperation in Ecuadorian Criminal Procedure Legislation" aims to carry out a brief study of this kind of Criminal Law in Ecuadorian legislation, specifically through the application of the so-called effective cooperation of the investigated or prosecuted, who voluntarily, after admitting the commission of a certain crime, agrees with the prosecution to provide information, data, instruments that allow clarifying the facts or preventing other crimes; this agreement that is not always fulfilled or becomes ineffective whose main cause lies in the leak of information, either by the investigated or prosecuted, the technical defense or the prosecution itself. The methodology used in this research work is within the explanatory descriptive level since the problem to be developed will be determined, being also documentary since the information has been collected from the review of works by several authors and duly supported by the legislation. Ecuadorian prison; and on the other hand, it is a field investigation through interviews with several professionals from the criminal area, as well as prosecutors from the province of Tungurahua, reaching as a result that in this type of investigation, with the cooperation of the investigated or prosecuted, it is applied mainly in organized crime crimes with the aim of dismantling criminal networks, but since there is a leak of information, the application of this legal figure is very sporadic, without fulfilling the purpose for which it was created and without that the cooperator sees the benefits of their cooperation in the investigation |
