Descripción
Sumario:In the present paper are studied some particular problems of criminal unlawfulness, such as self-defense on a third party, the weighting between lives in a state of necessity or the concurrence of intensive self-defence and mistake regarding the excess in legitimate defense. The common factor to all of them is that they deal with concrete but complex issues, which forces us to go deeply into the relations between self-defence and necessity, into the division between justification and excuse, or into the limits of the massacre avoidance principle.
