Descripción
Sumario:This paper aims to carry out a critical analysis of Corporate Offenses, focusing on the criminal liability of legal entities in Brazil, and a brief study of the case of the collapse of a dam belonging to the company VALE S/A in the city of Brumadinho/ MG and its possibility of liability. VALE S/A, despite having a compliance system for possible risk assessment, proved to be fragile and extremely ineffective. A Parliamentary Commission of Inquiry was created to investigate the case, the Minas Gerais Public Prosecutor's Office also produced evidence, but a lot of time passed and until the moment of its protocol, nothing had been resolved. This does not happen to those who do not have influence and high economic power in this country. As a methodology, the deductive method was used, in addition to bibliographical, legal and documentary research.
