This work encourages critical reflection of these changes, emphasizing the legal grounds of the adoption of objective and subjective responsibility in the Brazilian legal system and constitutional principles that serve as subsidy to that effect.As modificações trazidas pela Lei nº 13.286/2016 substituíram a aplicação da responsabilidade objetiva no âmbito do serviço notarial adotando-se a modalidade subjetiva no caso de dano praticado contra terceiro. Ademais, fixou-se o prazo prescricional de três anos para as ações indenizatórias intentadas em face destes profissionais.
