Sumario:The changes introduced by Law No. 13.286/2016 replaced the application of strict liability under the notarial service by adopting the subjective mode in case of damage committed against a third party. In addition, it sets up the limitation period of three years for claims for damages brought in the face of these professionals. This work encourages critical reflection of these changes, emphasizing the legal grounds of the adoption of objective and subjective responsibility in the Brazilian legal system and constitutional principles that serve as subsidy to that effect.
