| Sumario: | Social evolution in the face of technological advances has generated major transformations in the Judiciary, especially with the evolution of Online Dispute Resolution (ODR) as an alternative means of guaranteeing access to justice. The objective of the research is to analyze whether only technological and alternative means of conflict resolution guarantee full access to justice, based on the review of the first and third renewal waves by Mauro Cappelletti and Bryant Garth. The methodology used presents a qualitative approach, deductive method and exploratory character. The results indicate that technological vulnerability must be investigated so that effective proposals can be formulated to guarantee effective access to justice. It is not enough for the Judiciary to provide means of access to Justice without guaranteeing that the jurisdiction is able to follow these evolutions and, in this way, guarantee substantial and effective access to justice. |
