Resumo:This research will present the understanding of non-property digital assets and their discussion in the Brazilian legal system. In Brazil, there is still no regulation on the transferability of social networks and other non-property digital assets after the death of the user, which makes it difficult to solve the specific case regarding the succession. Several websites and social networks have in their terms and conditions specifications regarding the destination of the personal page after death. However, it is questioned about the validity of these clauses, since, in some cases, the website becomes the owner of all personal information contained on the virtual page after the death of its owner. It is argued that there must be respect for the deceased´s right to privacy, regardless of his manifestation for that, and there is no right to transfer this information after his death, in which the company holding the information must delete it. In this paper, the hypothetical-deductive method is used, and analysis of some cases dealing with the theme in Brazil, the United States and Germany.
