Sumario:Article aims to discuss, from the evolution of the concepts of family and membership, the legal value of affection. Therefore, we will draw a parallel between biological paternity, restricted to a conception of genetic and socio-affective paternity, which depicts the subjectivity of the links established by the noble feelings of love, affection, care, among others, to show that the right comes assigning greater value the personal relationships when in conflict with the strictly biological relationship.
