description The main objective of this article is to understand what are the philosophical implications that the principles of justice as equity of John Rawls have for affirmative action policy. For that, I begin by addressing some central concepts in the theory of justice as fairness, namely, ideal theory and non-ideal theory, philosophical presuppositions that are indispensable for dealing with injustice in non-well-ordered societies. Subsequently, I investigate the importance of articulating certain political values essential to a democratic society, seeking to justify the importance of the implementation of positive measures to guarantee corrective justice, considering that there are still societies in which the principles of justice are not fulfilled strictly. Next, I will analyze the principlesof justice that can guarantee a right equal to an adequate system of rights and freedoms, as well as equal opportunities for the less privileged in society when it comes to access to social goods. Finally, I propose the idea that the philosophical presuppositions of the theory of justice as equity justify the implementation of affirmative public policies, which leads to believe that such actions make possible, through redistributive and compensatory measures, the development of a more just society.

Para ello, empiezo abordando algunos conceptos centrales de la teoría de la justicia como equidad, a saber, la teoría ideal y la teoría no ideal, a presupuestos filosóficos indispensables para hacer frente a la injusticia en las sociedades que no son bien-ordenadas. Después, busco investigar sobre la importancia de articularciertos valores políticos esenciales para una sociedad democrática, tratando de justificar la importancia de la efectivación de medidas positivas para asegurar a la justicia correctiva, teniendo en cuenta que hay sociedades en las que los principios de justicia no se  cumplen estrictamente. A continuación, examinaré cuáles son los principios de justicia que pueden garantizar un derecho igual a un sistema adecuado de derechos y libertades, así como la igualdad equitativa de oportunidades para las personas desfavorecidas de la sociedad cuando se trata de acceso a bienes sociales. Por último, propongo la idea de que los supuestos filosóficos de la teoría de la justicia como justicia justifican la aplicación de políticas públicas afirmativas, lo que lleva a creer que tales acciones permiten, a través de medidas redistributivas y compensatorias, el desarrollo de una sociedad más justa. O objetivo central desse artigo é buscar compreender quais são as implicações filosóficas que os princípios da justiça como equidade de John Rawls tem para a política de ações afirmativas. Para tal, inicio tratando de alguns conceitos centrais na teoria da justiça como equidade, a saber, a teoria ideal e a teoria não ideal, pressupostos filosóficos indispensáveis para lidarmos com a injustiça nas sociedades não bem-ordenadas. Posteriormente, investigo acerca da importância de se articular determinados valores políticos essenciais para uma sociedade democrática, buscando justificar a importância da efetivação de medidas positivas para se garantir a justiça corretiva, considerando-se que ainda há sociedades em que os princípios de justiça não são cumpridos de forma estrita. Em seguida, passo a analisar quais são os princípios de justiça que podem garantir um direito igual a um sistema adequado de direitos e liberdades, assim como, a igualdade equitativa de oportunidades para as pessoas menos favorecidas da sociedade quando se trata de acesso aos bens sociais.
