| Sumario: | The work focuses on the anthropological report, an instrument used in criminal proceedings that have indigenous people as defendants. It has as a research problem: the anthropological report is an effective legal means for the intersection between the positivist penal system and indigenous customary law in the light of the case “Ministério Público Federal v. Valdenei da Silva”? The justification refers to the need to interpret the crimes considered illegal by the positivist penal system in the light of the ethnic perception involved. General objective: to observe if the anthropological report is essential to understand the ethnic system. It is observed that the anthropological report enabled the intersection between the positivist penal system and indigenous customary law, concluding that the conduct is culturally atypical. |
