| Sumario: | This paper aims to affirm the importance of rhetoric to decision contexts, recognizing that its characteristics are essentials to many fields, going beyond its role in literature, and that the literature, through the rhetoric, get argumentative power in another fields, such as legal field. Therefore, the decisions of Brazilian Supreme Court’s judges are analyzed, in the hard cases, from the proposal of Toulmin’s general pattern of argument, enabling to observe as literary arguments are used to justify decisions. |
