Descripción
Sumario:The present article deals with restorative justice as a model of justice under construction. The problem addressed is the following: is indigenous restorative justice a manifestation of jusdiversity? The objective is to verify the hypothesis of the development of indigenous community's own mechanisms with indigenous restorative justice, as a way to promote harmony between the state and indigenous justice system, through prior consultation. To this end, the hypothetical deductive method and bibliographical research were used, based on the theoretical contributions of critical criminology from an intercultural perspective. The results consist of an analysis of the potentiality of indigenous restorative justice in contexts in which voluntary and dialogical restorative practices are welcomed by indigenous communities and favor manifestations of jusdiversity.
