| Sumario: | The exercise of citizenship in Brazil can be identified even in the face of serious scenarios of social inequality and poverty, being present in the trajectories of the most diverse collectives and groups. The task is to understand the institutional arrangements that tend to prevent citizen practices from being carried out satisfactorily. A relevant concept to this understanding, when critically reviewed, is that of regulated citizenship, suggested by Wanderley Guilherme dos Santos in the context observed after the 1930s. Based on this concept, orienting himself through the notion of constitutional paradigms in the formulation of Jürgen Habermas, seeks to address the issue of citizenship within the framework inserted by the 1988 Constitution. In the end, considerable institutional changes are perceived regarding the internal nexus that articulates work, constitution and democracy. The present project invites us to reconstruct the paths of citizenship in Brazil to support, based on the discursive theory of law and democracy, its contemporary concept, according to which the presumption of rationality and legitimacy of the (Democratic) State of Law supported by constitutively, in the common exercise of citizenship by all involved. It is an entirely bibliographic research, carried out, above all, based on the reading of the referenced works. |
