Moreover, several scholars which defend a cosmopolitist stance that believes that even though it shares some similarities with A Theory of Justice, it doesnt holds the same standards for individuality and freedom protection as the former.O objetivo do presente trabalho é analisar a crítica cosmopolitista, de fundamento no ser humano, diante do Direito dos Povos do autor norte-americano John Rawls. Inicialmente, apresenta-se uma série de questões de ordem formal. Posteriormente, dá-se início a uma exposição dos conceitos fundamentais da teoria Justice as Fairness de John Rawls. A seguir, apresenta-se ainda o projeto de princípios para o Direito Internacional proposto por Rawls, o chamado Direito dos Povos. O Direito dos Povos é uma tentativa de extrapolar as ferramentas desenvolvidas para a esfera doméstica, para utilização no Justice as Fairness, para a ordem internacional.
