Sumario:It is intended to raise a critical-reflective analysis about the occurrence of a possible administrative activism within the scope of the Court of Auditors of the Union, more specifically in its supervisory role with mixed capital companies that exploit economic activity. In this sense, we seek to analyze the constitutional and legal context of the matter, with emphasis on article 90 of the Law of State-owned Companies (Law No. 13.303/2016), especially as a limitation of the supposed administrative activism, through the recognition of the managerial autonomy of these companies.
