| Sumario: | This article has the scope to analyze the influences left by Hans Kelsen and his Teoria Pura do Direito for legal hermeneutic sand the uncertainties still present in his classic book on the interpretive process. Positivism kelseniano, recognized by the separation between law and morality, not omitted as to the reality of legal interpretation, and, without disregarding their theoretical bases, left guidelines for the consolidation of a theory of interpretation. Kelsen developed the concept of legal frame as a limit to the authentic interpreter of the rule whose subjectivity influence the interpretative process,but also saw interpretations outside this frame. This work intends to understand these possibilities of interpretation, analyzing Hans Kelsen and his teachings about legal interpretation. |
