In order to demonstrate the current relevance of the andradino project for the cultural patrimony – especially for the centrality which the inventory represents in his preservation vision – there is an attempt at reconstructing the constitutional course of this preservationist thought and practice, whose dialogue with the letters, travel diaries, chronicles, laws and literature of the period reveal sharp attunement with the modernistic projects of construction of a “Brazilianness”, which comprehends the discovery journeys to Brazil and Mario de Andrade’s experience in the Departament of Culture of São Paulo - 1935-1938.Este artigo busca discutir o conceito de arte patrimonial elaborado por Mário de Andrade para o anteprojeto de criação do Serviço do Patrimônio Artístico e Nacional – SPAN, em 1936, como elemento indiciário da trajetória de uma concepção ampla de patrimônio cultural configurada no decreto 3.551/2000, que instituiu o registro e inventário do patrimônio cultural de natureza imaterial.
