Revista da Faculdade de Direito, Universidade Federal do Ceará, Fortaleza, v.36, n.2, p. 111-134, jul./dez., 2015.This study aims at the analysis of Andean Constitutionalism, inaugurated by the Constitutions of Ecuador (2008) and Bolivia (2009), and its characteristics that have brought new light to the worldwide constitutional law, such as the recognition of the rights of nature, legal pluralism, participatory democracy and human rights, with emphasis on a “good living” policy. The next step will be the UNASUR, as the latest attempt at South American regional integration, drawing a parallel between the two, pointing out how Andean Constitutionalism can contribute to the integration process sought by the UNASUR. Therefore, a bibliographical and legislative research is carried out, which concludes that, despite being both Andean Constitutionalism and UNASUR, both are particularly relevant to a policy of reducing the inequalities that affect Latin America so much in the search of genuinely democratic and pluralistic societies. The present study aims to point out the possibility of UNASUR, as a new South American integration project in force, to be a bridge for a regional union that surpasses the merely economic bias and can finally succeed in the construction of a South American identity truly concerned with the well-being of man in its entiretyO presente estudo tem por objeto a análise sobre o Constitucionalismo Andino, inaugurado pelas Constituições do Equador (2008) e da Bolívia (2009), e suas características que trouxeram novas luzes para o Direito Constitucional mundial, como o reconhecimento aos direitos da natureza, ao pluralismo jurídico, à democracia participativa e aos direitos humanos, com ênfase em uma política do “buen vivir”. Em seguida abordar-se-á sobre a UNASUL, como mais recente tentativa de integração regional sul-americana, traçando-se, por fim, um paralelo entre ambos, pontuando-se como o Constitucionalismo Andino pode contribuir para o processo de integração almejado pela UNASUL. Cuida-se, portanto, de uma pesquisa bibliográfica e legislativa que conclui que, não obstante ser tanto o Constitucionalismo Andino como a UNASUL movimentos em construção, ambos assentam especial relevância para uma política de redução das desigualdades que tanto afetam a América Latina, na busca constante de sociedades verdadeiramente democráticas e pluralistas.
