| Sumario: | This article's theme is the personality right of the LGBT community: respect for homoaffective personality in the brazilian legal system. The following problem was investigated:" The personality right of the LGBT community (lesbian, gay, bisexual, transsexual, transvestite and transgender) is respected by the Brazilian legal system?". The following hypothesis was hypothesized: "the personality right of the LGBT community is respected by the Brazilian legal system". The overall goal is to "Analyze whether the right of LGBT personality is respected by the Brazilian legal system". The specific objectives are: "List constitutional principles within the personality"; "Discuss the legislative applicability of lgbt rights to the public"; "Investigate discrimination and homoaffective prejudice". This work is important from an individual perspective due to the importance of egalitarian sexual freedom; for science, is relevant because it's necessary to debate and comply with the rules on gender freedom; it adds to society by its need for greater legal and legislative protection, guaranteeing rights and duties to affective diversity without discrimination. This is a theoretical qualitative research, lasting six months. |
